This Privacy Policy describes, inter alia, the ways in which personal data collected through the www.martz.eu website are obtained, the purposes and legal basis of the processing, the rules for storing and sharing, and the methods for protecting personal data (hereinafter: "Martz.eu" or "Website").
The personal data of Martz.eu users are processed in accordance with the provisions of commonly binding law, in particular the provisions of:
1) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 2016.119.1) (hereinafter: “GDPR”);
2) Act of 10 May 2018 on Personal Data Protection (Journal of Laws of 2018, item 1000, as amended);
3) Act of 18 July 2002 on the Provision of Services by Electronic Means (Journal of Laws No 144, item 1204, as amended)
4) Act of 16 July 2004 - Telecommunications Law (Journal of Laws No 171, item 1800, as amended).
Whenever this document refers to:
1) Personal Data – means information about an identified or identifiable person, based directly or indirectly on an identifier such as a name, an identification number, location data, an online identifier or on one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of the natural person;
2) Personal Data Processing – means any operation which is performed upon personal data, such as collection, recording, organisation, ordering, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;
3) Personal Data Controller – means an entity which, alone or jointly with others, determines the purposes and means of processing personal data;
4) User – means any natural person visiting the Martz.eu Website and/or using one or more of the services or functionalities made available on the Website.

In matters related to personal data protection, contact with us is possible via e-mail at [email protected] or via traditional mail to the following address: Martz Sp. z o.o.; Al. Lotników Polskich 1, 21-040 Świdnik.
We primarily obtain personal information directly from Martz.eu Users. Users provide or leave their personal data at different stages of using the Website. Data are collected:
1) when a message is sent to us via the contact form on the “Contact” subpage, we receive the following: first and last name; e-mail address and possibly other personal data included in the message, as well as the IP address of the computer from which the enquiry was sent ;
2) when applying for a job vacancy via the application form on the "Careers" subpage, we receive the following: first and last name; email address, a number of personal details included in the documents attached to the application, and the IP address of the computer from which the enquiry was sent;
3) when a message is sent to us via the contact form on the “Become a Dealer” subpage, we receive the following: first and last name; e-mail address, phone number, email address, name of the province and possibly other personal data contained in the message, as well as the IP address of the computer from which the query was sent;
4) automatically during a visit to Martz.eu, we receive information collected by cookies, characterising the way in which the User uses our Website, e.g. date, start and end date of the visit and the scope of the visit, information about the operating system and about the web browser used by the User, information about the type of device used and the IP address (Internet Protocol).
We do not collect sensitive personal data, i.e. data concerning health, revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership and genetic data. We adhere to the principle of collecting and processing only such personal data that are necessary for the purposes for which they will be processed.
We process personal data of Martz.eu Users only to the extent that it is necessary to achieve the purposes for which they were collected. The table below presents the purposes and the corresponding legal basis of personal data processing.

Access to personal data collected through Martz.eu is primarily granted to our authorised employees. In justified cases, we transfer or may transfer certain personal data to the following data recipients:
1) entities entitled to obtain personal data on the basis of legal regulations, for the purposes of proceedings conducted by them, e.g. public authorities and entities performing public tasks or acting at the request of public authorities;
2) entities whose services we use, commissioning them to perform tasks involving the need to process personal data on behalf and for the benefit of the Company - these will include entities performing services on our behalf, necessary for the proper functioning of Martz.eu and for meeting our legal obligations or for the execution of our legally justified interests, e.g:
a) a company providing data hosting and e-mail hosting services to our company;
b) a company that assists us in administering Martz.eu and providing maintenance services for the Website,
c) a company providing maintenance and service of our IT infrastructure and software;
We do not sell or exchange personal data obtained through the Website or exchanged with other entities for marketing purposes.
Personal data will not be transferred to any country outside the European Economic Area (which includes the countries of the European Union, Norway, Liechtenstein and Iceland) or to any international organisation.
Personal data collected via the Website will be processed only for the periods necessary to achieve the purposes for which they were collected.

At the end of the retention period, personal data will be deleted or anonymised.
We comply with all the rights of data subjects under the GDPR. Any data subject shall have the right to:
1) access their personal data, i.e. the right to verify what personal data are being processed by us and to obtain information concerning, among other things, the purpose for which and the legal basis on which the data are being processed, to whom the data are being made available and when it will be erased;
2) request the rectification of personal data where data are inaccurate, and to request that data be completed where they are incomplete
3) request the erasure of personal data insofar as there is a circumstance provided for by law (i.e. Article 17 of the GDPR) which justifies this request;
4) request the restriction of the processing of personal data in cases provided for by law (i.e. Article 18 of the GDPR);
5) data portability - i.e. the right to receive from us, in a structured, commonly used machine-readable format (e.g. txt., doc., rtf., xls., odt., pdf., jpeg., xml. formats), personal data provided by the User and the right to have this data transferred to another controller or to request that we transfer the personal data directly to another controller, if technically feasible;
6) object at any time to the processing of their personal data on the basis of that person's particular situation - where the processing is carried out on the basis of our legitimate interests or for statistical purposes, and the objection is justified by a particular situation where our further processing of personal data puts the privacy of the person at risk.
Where the processing of personal data is based on consent, Martz.eu users have the right to withdraw that consent at any time. However, this will not affect the lawfulness of the processing that was carried out on the basis of the consent before its withdrawal. Withdrawal of consent for the purposes of the recruitment process may be done by sending us a relevant message to [email protected] .
The rights mentioned above can be exercised, inter alia, by sending us a relevant request to the email address: [email protected] or by post to: Martz Sp. z o.o.; Al. Lotników Polskich 1, 21-040 Świdnik. Such a request should contain data which will enable us to clearly identify the applicant and to fulfil the request in accordance with the application.
Any data subject who considers that the processing of their personal data by us violates their rights also has the right to lodge a complaint to the supervisory authority - the President of the Office for Personal Data Protection (ul. Stawki 2; 00-193 Warsaw).
Providing personal data is not mandatory, but it is necessary to use certain functionalities of Martz.eu. Without providing your personal data you will not be able to send us a message via the contact form or submit your application for a vacancy.
Personal data obtained through Martz.eu is not processed in a way that would result in automated decision-making, including profiling. This means that we do not use IT systems that would collect information on individuals and then independently, automatically, make decisions that could produce legal effects on those individuals or similarly significantly affect their situation.
Personal data collected via our Website are secured in accordance with the guidelines under the GDPR. We apply appropriate technical and organisational measures to ensure a proper degree of protection of personal data and to protect them against accidental or deliberate destruction or damage, accidental loss, modification, disclosure to unauthorised persons or takeover by an unauthorised person. For example:
we use secure internet connections on Martz.eu, encrypted with an SSL certificate, which is intended to ensure the confidentiality of data transmission sent over the Internet;
personal data are stored on secure servers;
personal data may be processed only by our specially authorised employees and only to the extent necessary for the performance of their tasks;

we strive to ensure that the entities entrusted with the processing of personal data give guarantees of the application of appropriate security measures and adequate protection of personal data.
Like many other websites, Martz.eu uses cookies to collect and process anonymous data about users. Cookies are small text files sent by visited websites and saved on the user's computer. They may contain information such as: the User's IP address; the name of the website they come from; the time they are stored on the User's end device; a record of parameters and statistics; and a unique number. The information contained in these files can only be read by the website that created them.
Data collected using cookies do not allow for the unambiguous identification of a person. Cookies can be considered personal data only in connection with other identification details, provided by the User while using the Website.
Cookies are used in our Website in order to:
maintain the technical correctness and continuity of the session between the Website server and the User's terminal device;
optimise the use of websites by the User and adjust the manner of their display on the User’s terminal device;

The content of this Privacy Policy may be subject to change. Changes to the Privacy Policy may be necessary or needed, for example, if there is a change in the law, new guidance from supervisory authorities, changes to the technology by which we process personal data, or changes to the ways, purposes or basis of processing personal data. Users of the Website will be informed of any changes.
